In addition to the terms stated in Terms of Use provided under the website/mobile application, XMTopper are committed to protecting your privacy. Only authorized representatives of XMTopper and on a need to know basis only use any information received from you and as consented by you. XMTopper constantly review our systems and data to secure your personal information. In the event of any identified unauthorized use or disclosure of information or upon your complaint, we will investigate any such complaint or such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible. Any User who does not agree with any provisions of this Privacy Policy and the Terms of Use is required to leave the application but if you still continue to access the application and provide your personal information, disclaim all the liabilities arising therefrom and it shall be assumed by your continued use of the application that you have accepted the Policy and any other online terms and conditions available on the application.
If any information you have provided or uploaded on the App violates the terms of this Policy, XMTopper may be required to delete such information upon informing you of the same and revoke your access if required without incurring any liability to you.

- APPLICABILITY
This privacy policy applies to all users who access the App and are therefore required to read and understand the policy before submitting any personal information. By submitting personal information, you are consenting to the use and processing of such information in accordance with this policy. If you have inadvertently submitted any personal information to XMTopperprior to reading the policy statements set out herein, or you do not agree with the manner in which the personal information is collected, stored or used, then you may access, modify and delete all information stored about you by writing to us at support@aaamt.in. XMTopper is keeping personal data of the user, and every user is also entitled to require XMTopper to delete and destroy all such information (but not that of other users).
This Policy applies to the App and any other services that are owned and operated by XMTopper. Third party websites may place their own cookies or other files on the users’ computer, collect data or solicit personal information from the users, for which XMTopper is not responsible or liable. Accordingly, XMTopper does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does XMTopper guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by XMTopper of the website, the website’s provider, or the information on the website. XMTopper encourages the user to read the privacy policies of each such website and the user understands that it’s solely such third party who is responsible to the user in this regard.
XMTopper has taken reasonable precautions as per applicable Indian law and implemented industry standards to treat personal information as confidential and to protect it from unauthorized access, improper use or disclosure, modification and unlawful destruction or accidental loss of the personal information.

- ACCESS
User are allowed to access the App, register for courses and avail services available with XMTopper as a guest and without creating an account on the App or providing any personal information, XMTopper takes no responsibility or validate the information provided by the guest, except as otherwise required under any law, regulation or an order of competent authority. In order to have access to all the features and benefits on our App, a user is required to first create an account on our App. To create an account, a user is required to provide personal information as may be required during the time of registration. XMTopper may, in future, include other optional requests for information from the user to help XMTopper to customize the application to deliver personalized information to the User. Without User’s agreement, XMTopper will not share, rent or sell any Personal Information with third parties in any way other than what is disclosed in this Policy. XMTopper may keep records of telephone calls received and made for making enquiries, registered courses, feedback or other purposes for the purpose of rendering services effectively and efficiently.

Personal Information
shall mean the information which identifies the User, name, identification number, email address, age, gender, or phone number provided to XMTopper at the time of registration or any time thereafter. Personal information may include sensitive personal information or data
as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and in this context, includes passwords or any financial account information provided by You during registration.
We request you to not provide us with any Personal Information unless specifically requested by us. In such events, we bear no liability to such Personal Information provided by you.

- AUTOMATIC INFORMATION COLLECTION
Our system collects information that is sent over the internet without your control. Some examples of the information we collect and analyse include the Internet protocol (IP) address used to connect Your computer to the internet; login; email; password; computer and connection information such as browser type and version, operating system, and platform; course enrolled history, which we sometimes aggregate with similar information from other users to create features, reports such as popular courses, most used features etc; the full Uniform Resource Locator (URL) click stream to, and from our application, including date and time; cookie number; courses or videos You viewed or searched for; the email id You used to call our customer service.
During some visits we may collect session information, including page response times, download errors, length of visits to certain page, course and videos, page interaction information (such as scrolling, clicks and mouse overs), and methods used to browse away from the page.

- INFORMATION SECURITY
To protect the security of Your Personal information during transmission, we use Secure Sockets Layer (SSL) software, which encrypts information you input. To prevent unauthorized access to sensitive information, it is important for You to monitor those who have access to Your password and to Your computer, laptop or any other device through which Your account can be accessed. Be sure to sign off when finished while using a shared computer.
However, please do note that given the nature of internet transactions, XMTopper does not take any responsibility for the transmission of information including Personal Information shared by you other than as set forth in this Policy. Any transmission of information on the internet is done at your risk and shall not be responsible for the circumvention of the privacy settings or security measures either by you or any third-party.

- USE OF YOUR PERSONAL INFORMATON
While availing our services you will provide access to XMTopper with Your Personal Information. If that information is wrong, you can request us to modify or delete the same. XMTopper will take all reasonable measures to ensure that the Personal Information is modified and used for rendering services to you and as otherwise in compliance with laws. When editing or deleting Personal Information, we may ask you to verify your identity before we can act on your request. XMTopper may at its discretion reject any request that is contrary to law, requires un-reasonable technical efforts. We do not assure that we will delete all residual copies and archives made by any third party without our knowledge and consent. We never retain Your Personal Information longer than it is required for the purposes of providing services through the application or as required by applicable Indian law. At times, we may also require to transfer Your Personal Information to third-party service providers, for instance to authorize transactions we may share your financial data with such third-party providers. You hereby consent to your transfer of Personal Information in all such instances. XMTopper carries out all such transfers strictly in accordance with law. XMTopper shall use Your Personal Information to ensure services with respect to the application are presented to You in the most effective manner, to secure the application and make improvements, to carry out our obligations to You, and to communicate with You. The said communication can either be by calls, text or emails and for purposes which include transactional, service, or promotional calls or messages. If at any time you wish to not receive any communication from our end you can opt-out of the same by writing to us on support@aaamt.in.

- EXCEPTIONS
Your Personal Information may be shared with third parties who have a need or authority to receive such information, if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to comply with (i) in response to any authority having to receive such information under law (ii) any order of court (iii) detect, prevent, or otherwise address fraud, security or technical issues (iv) protect against harm to the rights, property or safety of XMTopper , our users or the public as required or permitted by law.

- USER CHOICES WITH REGARD TO ACCESS OF INFORMATION
Xmtopper does not make any unsolicited calls or otherwise market any products or services, except for in relation to the purpose for which such information has been provided or taking any feedback, addressing any complaints, informing you about new features or free/paid courses. User shall not disclose their Personal Information to any third parties that is not authorised by XMTopper and verify the identity of such person who seek information. XMTopper will communicate with the Users through call, SMS, email or notices posted on the application or through any other means available, which shall include but not be limited to text, other forms of messaging, calls etc. The Users can change their e-mail and contact preferences at any time by logging into their account or by emailing at support@aaamt.in.
XMTopper may, if you so choose, send direct mailers to you at the address given by you. You have the option to ‘opt-out’ of this direct mailer by way of links provided at the bottom of each mailer. We respect your privacy and to the extent that you choose not to receive such mailers, we will take all steps to remove you from the list. Should you evidence any violation of our terms and policies, please write to us at support@aaamt.in and report such incident.
All the information provided to XMTopper by You, You as a User confirms that the same including sensitive Personal Information, is true, accurate and voluntary. User has the right to withdraw information at any time, in accordance with the terms of this Policy and the Terms of Use.

- REPORT, ANALYSIS & CONFIDENTIALITY
XMTopper may have to use Personal Information without reference to any person or identity for research, statistical analysis improving the application of functionalities offered thereon and business intelligence purpose and may transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.
All XMTopper employees and data processors, who have access to, and are associated with the processing of sensitive personal data or information, are obliged to respect the confidentiality of every User’s sensitive personal data and information.

- SHARING OF INFORMATIONS
XMTopper may also disclose or transfer User’s personal and other information which a User provides, to another third party as part of reorganization or a sale of the assets of XMTopper corporation division or company. Any third party to which XMTopper transfers or sells its assets will have the right to continue to use the personal and other information that a User provide to us.
To the extent necessary to provide Users with the services on the Platform, XMTopper may provide User’s Personal Information to third party contractors who work on behalf of or with XMTopper to provide Users with such services, to help XMTopper communicate with Users or to maintain the application. Generally, these contractors do not have any independent right to share this information, however certain contractors who provide services for the application, including the providers of online communications services, online payment gateway services, will have rights to use and disclose the Personal Information collected in connection with the provision of these services in accordance with their own privacy policies. Furthermore, please note that we cannot control the actions of other Users of the application with whom you may choose to share Your Personal Information, and any such actions on your behalf shall be solely your responsibility.

On unaffiliated sites, XMTopper may display interest-based advertising using information you make available to us when you interact with our application, content, or services. Interest-based ads, also sometimes referred to as personalised or targeted ads, are displayed to you based on information from activities such as subscription on our App, visiting sites that contain XMTopper content or ads. In providing interest-based ads, we follow applicable Indian laws, as well as the Code for Self-Regulation in Advertising by the Advertising Standards Council of India and the Self-Regulatory Principles for Online Behavioral Advertising developed by the Digital Advertising Alliance (a coalition of marketing, online advertising, and consumer advocacy organizations).
Like other online ad networks, we use cookies, web beacons (also known as action tags or single-pixel gifs), and other technologies (collectively, cookies
). Cookies enable us to learn about what ads you see, what ads you click, and other actions you take on our sites and other sites. This allows us to provide you with more useful and relevant ads. For example, if we know what ads you are shown we can be careful not to show you the same ones repeatedly. - REVISION OF TERMS & GRIEVANCE REPORTING
XMTopper may update or amend this Policy at any time, with or without advance notice. In the event there are significant changes in the way XMTopper treats User’s personally identifiable information, XMTopper will display a notice on the App or send Users an email. XMTopper shall not be required to notify the Users of any changes made to the privacy policy. Should you have any concern or reject the changes in the privacy policy you can refuse to accept the amendments and opt for withdrawing Your Personal Information by writing to us at support@aaamt.in.

) and XMTopper application (App
) and related services (together with the Webpage and App, the Service
), are brought to you by AAAMT Verticals Pvt. Ltd., India. Access and use of the Service is subject to the following terms and conditions. By using the Service, or using any aspect of the Service, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use the Service.
These Terms of Use constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.
For the purposes of this Agreement:
Beta
means the testing and evaluation of a specific Service by you and other customers or business partners.
Content
means digitised content obtained through the Service, such as questions, solutions, hints in text, image, audio or video format and other content.
Feedback
means all feedback, suggestions, and ideas (in written form and labeled as Feedback
, or, if initially provided orally, which is there after reduced to writing and sent to XMTopper after its oral disclosure and labeled as Feedback
) that you provide to XMTopper concerning improvements or enhancements to the Service.
Supported Device
means a mobile phone, computer or other supported electronic device on which you are authorised to operate the Service.
Test Observations
means all information relating to your use, testing or evaluation of the Service, including all observations or information regarding the performance, features and functionality of the Service or any related materials.
- Registration
In connection with registering for and use of the Service, you agree to:
- provide accurate, current and complete information about you as requested by XMTopper;
- maintain the confidentiality of your password and other information related to the security of your account;
- maintain and promptly update any registration information you provide to XMTopper while registering or during your usage of the Service, to keep such information accurate, current and complete;
- be fully responsible for all use of your account and for any actions that take place through your account; and
- be contacted by us via emails, phone calls and/or SMS notifications for verification and communication purposes.
In the event any mandatory information is not provided, the registration shall be deemed to be incomplete and use of the Service may be restricted or blocked. By registering, you certify that all information you provide, now or in the future, is accurate.
If you have already registered for an account, you may use your existing credentials to access the App and/or the Services.
- Use of the App
You may use the App only on Supported Devices. The App will use Wi-fi or mobile data to download data for the App. Where Wi-fi is not available, the App will default to mobile data for downloads, which may occur without prompting the user. You may incur data charges upon usage of mobile data as per your mobile plan.
- Beta Features
You acknowledge that the Service is being Beta tested and may face outages, breaks in performance and that the Service may not be available at all times. XMTopper will own in perpetuity any Feedback or Test Observations shared by you. XMTopper may use the Feedback and Test Observations in any manner decided by XMTopper in its sole discretion.
- Eligibility
Use of the Service is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e., under the age of 18 years, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent and warrant that you have the authority and capacity to abide by this Agreement.
- License
We hereby grant you a limited, non-exclusive, non-assignable, non-transferable and revocable license to access the Service solely for your personal, solely on the Supported Devices and expressly conditioned upon your agreement that all such access and use shall be governed by this Agreement. The Content is licensed, not sold, to you by the Content Provider. You hereby expressly agree that you will use the Service only in a manner consistent with this Agreement.
- Copyrights and Trademarks
The Service and all accompanying materials are copyright protected by XMTopper.com or its affiliates. All logos are trademarks or registered trademarks of XMTopper or its affiliates. All rights reserved. Access and use of the Service does not grant or provide you with the right or license to reproduce, remove, alter or otherwise use any of the copyrights or trademarks or registered trademarks of XMTopper or its affiliates.
Content provided on the Service may be created by XMTopper, procured from third party Content Providers, or sourced from available resources.
All Content including the question papers provided on XMTopper is provided on an as is
basis and it makes no representation or warranty as to the adequacy, accuracy, completeness, reliability or correctness of such Content obtained from a third party entity.
- Liability
You expressly agree that any access or use of the Service and the Content is at your sole risk. XMTopper reserves the right, in its sole discretion and without prior notice, to modify, terminate, or suspend the Service at any time. XMTopper is not responsible for injury or damage resulting from downloading any materials in connection with the Service. The Service may be temporarily unavailable from time to time due to required maintenance, telecommunication interruptions, or other disruptions. Access and use of the Service may be unavailable during periods of peak demand, system upgrades, malfunctions or scheduled or unscheduled maintenance or for other reasons.
XMTopper and/or its associated entities make no representations or warranties or conditions of any kind relating to the accuracy, suitability, completeness, result of use and error-free operation of the Service and its contents, information, software, products, features and services, or the Content, for any purpose.
Any analytical reports generated pursuant to your use of the Service, including your overall rank and percentile or comparison with other customers is limited to customers using the Service and is not indicative of your actual comparison with other students. Usage of our Services does not in any manner guarantee achievement of the same or similar percentile, rank or score in any examinations or admission to any educational institutions.
In no event shall XMTopper and/or its associated entities be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of the Service, or the delay in or inability to access or use or risk of loss of, the Service or any portion of it, or for any contents, information, software, products, features and services obtained through the Service, including but not limited to the loss of use of the Service, inaccurate results, loss of profits, business interruption, or damages stemming from loss or corruption of data or data being rendered inaccurate or incomplete, the cost of recovering any data, the cost of substitute services or claims by third parties for any damage to computers, software, modems, telephones or other property, or otherwise arising out of the use of the Service, whether based on contract, tort, strict liability or otherwise.
XMTopper reserves all rights and remedies available by law and in equity for any violation of this Agreement.
- Termination
XMTopper reserves the right, at its sole discretion, to alter, amend or terminate your access to the Service or any portion of it, at any time, without prior notice, including for any violation of this Agreement, any unauthorised use of the Service by you or assignment or transfer of the rights granted to you. Any termination by XMTopper shall not affect any right or relief to which XMTopper may be entitled, at law or in equity.
You may terminate your Service at any time by following the instructions available through the Service.
The provisions relating to representations and warranties, intellectual property, indemnification, liability, and miscellaneous provision of this Agreement shall survive any termination.
- Miscellaneous
Information provided to XMTopper. The Service will provide with information about the use of your XMTopper Application and its interaction with Content and the Service (such as questions attempted, content archiving, available memory, up-time, log files, and signal strength). You authorise XMTopper to use your interactions with the Service to enable functionality of the Service including to determine your rank, personalise content to be displayed to you and other Service features which do not work without using your data. You also authorise XMTopper to transfer your interactions with the Service to any third party service providers who may analyse this data on our behalf. If you do not consent to the use and transfer of your data or interactions with the Service in this manner, do not use the Service. Information provided to XMTopper may be stored on servers that are located outside the country in which you live. Personal information transferred to countries outside of India, if any, will be transferred as permitted by applicable data protection laws.
Information provided to Others. You are responsible for any information you provide to others using the Service. Any information you provide to a third party will be subject to the privacy policy or any similar terms that the third party provides to you, and will not be subject to the XMTopper privacy policy.
Changes to Service; Amendments. We may modify, suspend, or discontinue the Service, in whole or in part, including adding or removing Content from a Service, at any time without notice. We may amend any of this Agreement’s terms at our sole discretion by posting the revised terms on the Website. Your continued use of the App or any aspect of the Service after the effective date of the revised Agreement terms constitutes your acceptance of the terms.
This Agreement constitutes the entire agreement between XMTopper and you concerning the subject matter hereof. In the event that any of the terms of this Agreement are held by a court or tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. A waiver by XMTopper or you of any provision of this Agreement or any breach of this Agreement, in any one instance, will not waive such term or condition or any subsequent breach of this Agreement. XMTopper may assign its rights or obligations under this Agreement.
Disputes. Any dispute or claim arising from or relating to this Agreement or the Service is subject to the governing law, disclaimer of warranties and limitation of liability and you agree to those terms by entering into this Agreement, purchasing or using Content, or using any aspect of the Service.

Cancellation and Refund Policy
If you cancel your subscription with in 24 hours of getting your confirmation and before the start of the course without providing any reason, you are entitled to a full refund of the price paid, subject to certain conditions.
Cancellations and refunds made in circumstances other than those described above, or after the 24 hours cancellation period has expired, are subject to the terms and restrictions outline in this Cancellation and Refund policy. To be clear, the cancellation time will expire 24 hours after the Order is Confirmed.
We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of this reimbursement.
If you start to use our services during the cancellation period (i.e. if the course commences during the 24 hours cancellation period) and/or if you access the course materials via our online course spaces (i.e. via our virtual learning environment), no refund will be payable.
Cancellation by XMTopper
Whilst every effort is made to avoid changes to our program, XMTopper reserves the right to withdraw or cancel any course. If for any reason we cancel a course, all course fees will be returned in full.
